Is there a statute of limitations on copy right infringement? Can this fall under that?

as that first depiction of zuggernaut was back in 1988, i believe something was said about ripping off the guyver as his later appearances totally changed, funnily enough to more of a ripoff of alien!

 

i wonder if maybe this actually turned off some western people from guyver, as newbies to manga they mistook this/or the first appearance of the zuggernaut to be takaya's work of the guyver?
